UK / Canada wedding – Certificate of Authority?

Hello, My boyfriend is in the UK with an Ancestry Visa – she has been here three years and is still valid for another 2. We married in early July. We have received the forms in the registrar's office, who say that someone from outside the UK wishing to marry must have a Certificate of Authority of the Home Office in the UK, if not older than six months left on his entry. Can someone who has been in this situation please comment on their experiences, as to whether they needed, and how long it took to request and receive the certificate? The current wait is between 20 and 70 days of work, which does not leave much time before our wedding. Any views would be gratefully received. Thank you very much Gordon Sorry, I forgot to say I am a British citizen.

It was a very successful recent challenge to the provisions for certificates of approval, so a legal advice appropriate. The Ministry of Interior (BIA) website does not mention any changes after this legal battle, so I am very sure how things stand now. Also no mention about not need a COA if more than six months left on his visa – and my understanding that applies to any person without permanent residence rights. As her fiance visa would normally lead to indefinite leave to remain in any case, it would also anticipate many problems geting the COA for her, but it is only other expenses that could do without. You as a Canadian citizen would also have to apply for a COA if you are already legally in the UK – whether you're here illegally Comment If you forget you are a foreigner, you should apply for a fiancĂ© visa. You should not try to marry, while a visitor visa. The only fiancĂ©e visa be granted if your boyfriend can show that it can support and accommodate you without public support. I think it would be appropriate for the two to consult a lawyer find the best way through this. You might also consider getting married in Canada. Good luck!
